The following Health & Safety reference document provides meeting minute snippets of important closures over the years and established jurisprudence:
Canada Labour Code 126(1) requires all employees to "report to the employer any thing or circumstance in a work place that is likely to be hazardous to the health or safety of the employee, or that of the other employees or other persons granted access to the work place by the employer"
Report all hazards using the safety hazard reporting app. If the response you receive from the employer does not resolve your hazard please contact a health & safety representative. The Internal Complaint Resolution Process (ICRP) as set forth under 127 of the Canada Labour Code will be utilized to resolve the hazard. The following Job aid further explains the ICRP:
The right to refuse dangerous work.
Any employee has the right to refuse dangerous work as long as they have reasonable cause to believe that it presents a danger. Specifically the Canada Labour Code states an employee may refuse in the following circumstances:
To use or operate a machine that constitutes a danger to the employee or to another employee;
To work in a place;
To perform an activity that constitutes a danger to the employee or to another employee.
The code contains certain exceptions regarding the right to refuse dangerous work. These exceptions include: if the refusal puts the life, health or safety of another person directly in danger; or, if the danger in question is a normal condition of employment.
The definition of danger reads as follows: “any hazard, condition or activity that could reasonably be expected to be an imminent or serious threat to the life or health of a person exposed to it before the hazard or condition can be corrected or the activity altered.”
