SPECIFIC
FATIGUE MANAGEMENT PLAN FOR EMPLOYEES WORKING IN EXCESS OF 64 HOURS IN A SEVEN
DAY PERIOD
1.1
This plan is developed in accordance with the requirements of Section 6,
subsection 6.2.4 (b) of the Work/Rest Rules for Rail Operating Employees and
covers Operating Employees who may be on-duty in excess of 64 hours in a 7 day
period.
2.1
Upon return to the home terminal, an employee's total accumulated on-duty
hours in the 168-hour period immediately preceding the off-duty time, exclusive
of arbitrary and allowance payments, will be calculated.
If the total accumulated on-duty hours in this period exceed 64, the
employee will be subject to a mandatory 24 hours off-duty exclusive of call
time.
3.1
In the event that an Operating Employee;
a) returns to the home terminal;
b) has in excess of 64 hours in the 168 hour period immediately preceding
going off duty and;
c) the mandatory 24-hour off-duty period will end between the hours of
2200 and 0400,
the
employee will be entitled to extend the rest period up
to an additional six hours but no later than 0400 the following morning. This
election to defer must be made at the time the employee first goes
off-duty.
Examples: An employee who goes off duty at 2200 on March 1st can book extended rest until 0400 on March 3rd. An employee who goes off duty at 0200 on March 1st can book extended rest until 0400 on March 2nd.
4.1 On completion of any 24 hour off duty period at the home terminal, the employee’s 168-hour clock will be reset to 0.

SPECIFIC
FATIGUE MANAGEMENT PLAN FOR EMERGENCY SITUATIONS
1.1
This plan is developed in accordance with the requirements of Section 6,
subsection 6.2.4 (c) of the Work/Rest Rules for Rail Operating Employees and
covers Operating Employees who may be on-duty in excess of 12 hours in a single
tour of duty due to an emergency situation.
2.1
As per the provisions of the Rule, an emergency situation is defined as
"a situation where injury or harm has been sustained, or could reasonably
be sustained to employees, passengers, the public or the environment." In
situations as defined by the Rule, employees may be required to work in excess
of 12 continuous hours, in order to protect the environment, the public,
passengers or employees from such harm, injury or possibility thereof.
3.1
Declaration of an Emergency Situation, as defined by the Rule, will be
the responsibility of the Director - NMC (Assistant Director - Network Operations Center Montreal). Only crews directly impacted by this emergency
situation, that cannot be relieved, or crews that are immediately required to
perform duties related to the emergency situation, will be required to work in
excess of 12 hours. Crews so required, will be relieved of duty at the first
available opportunity.
3.2
When, due to
circumstances beyond the Company’s control, such as impassable road
conditions, it becomes necessary for Operating Employees to take rest en route,
arrangements will be made by the Company for the necessary accommodation,
including eating facilities, at the location at which rest is taken or the
Operating Employees will be transported to the nearest location where necessary
accommodation and eating facilities can be provided.
3.3 Crews that are unable to be relieved due to an Emergency Situation, but are otherwise not required to perform duties, will be provided the opportunity to nap during this downtime. Once the Emergency Situation has been stabilized or eliminated, the train will be expedited to the change off location. Locomotives may be removed from the train in order to expedite movement to a change off location when handling the train would otherwise significantly delay transit time of the affected employees to the change off location.
4.1
When an Emergency Situation is declared, and employees are required to be
on duty in excess of 12 continuous hours due to the Emergency Situation, a
report of such occurrence will be filed with Transport Canada in the form set
out at Appendix “A” - Emergency Reporting.
Such report will include the nature of the Emergency Situation, it's
duration, the number of operating employees involved, and their hours on duty. A
copy of the report will also be provided to the National Legislative Directors
of the Brotherhood of Locomotive Engineers and United Transportation Union at
the addresses set out in Appendix “A” - Emergency Reporting.

SPECIFIC
FATIGUE MANAGEMENT PLAN FOR EMPLOYEES IN WORK TRAIN SERVICE
1.1
This plan is developed in accordance with the requirements of Section 6,
subsection 6.2.4 (a) of the Work/Rest Rules for Rail Operating Employees and
covers Operating Employees working in assigned or unassigned Work Train Service
and where continuous on-duty hours exceed 12 hours.
1.2
The Work/Rest Rules permit Operating Employees in work train service to
work a maximum of 16 hours for a single tour of duty provided that a specific
fatigue management plan is in place to cover situations where on-duty time
exceeds 12 hours. Work Train Service where on duty time for Operating Employees
does not exceed 12 hours will not require a specific fatigue management plan.
2.1
For assigned work trains, bulletins will be issued 7
days in advance of the scheduled starting date.
The bulletins will identify as closely as possible the subdivision(s) on
which the work is to be performed, the
nature of the work and the scheduled work and rest days of the assignment.
For unassigned work train service, which is shorter in duration, employees will
be called in accordance with the existing rules contained in the collective
agreements(s). Employees called in
work train service will continue to be afforded the ability to book rest under
the road service provisions of the collective agreements.
3.1
Assigned work trains will be scheduled to suit service and employee rest
requirements. For every 5 days of operation Operating Employees in Work Train
Service will be entitled to two (2) assigned days off.
Assigned days off will be consecutive but will not necessarily be
allotted in every week or on the same says of the week for the life of the
assignment. While
in assigned work train service, Operating Employees so scheduled will not be
subject to the provisions of the Specific Fatigue Management plan for 64/7 until
released from work train service.
3.2
Operating Employees assigned to work train service will be subject to the
provisions of the specific fatigue management plan for employees working in
excess of 64 hours in a seven day period when accepting a call for other work
during their layover periods.
3.3 Operating
Employees assigned to work train service will not be considered absent when
unavailable for other work on their designated days off.
3.4 Operating
Employees assigned to work train service will be provided transportation to
their home terminal on scheduled rest days and return transportation to the
tie-up point of the work train following their rest days, unless other
arrangements have been mutually agreed to.
4.1 When laid up at an intermediate point, suitable sleeping and eating accommodations will be provided for Operating Employees in work train service.
5.1 Opportunity
naps will be afforded to all employees in work train service.
Regular breaks of short duration will be provided when the duties of the
work train crew so permit.
6.1 Operating Employees in work train service will be given an opportunity for meals at reasonable times. Crews will not be required to be on duty for extended periods of time prior to being given an opportunity to take a meal break. Opportunities for meal breaks will be granted upon reasonable notice, one hour being deemed sufficient. Requests for meal breaks can be made any time after four hours on duty, in no case will Operating Employees be required to work longer than six hours without being provided a meal break. A second meal period will be provided when the tour of duty is known or expected to exceed twelve hours.
6.2 Where work train equipment
includes facilities for providing meals to employees associated with the work
train, Operating Employees will be allowed to take their meals in such
facilities.
7.1 In wreck train service
(road auxiliary service) a second Locomotive Engineer will be provided to
augment the crew at locations to which relief cannot be readily supplied and
in circumstances where the hours on duty are known or expected to be
extensive.
8.1
Spare or regularly assigned employees released from work train service
will, upon going off-duty at the home terminal, be subject to the terms and
conditions required by the Specific Fatigue Management Plan for 64/7 if
applicable.
