Important Update:
Any member who has had Sick Leave (SL) claims automatically added to your Time-Slip Inquiry by the company when on off duty injury status after December 11, 2025; please contact your local chairmen. You will not be notified that these claims were added and you will need to look in your Time-Slip Inquiry (14) screen.
The Canada Labour Code is very clear that only the employee can decide to take paid medical leave days (SL Claim) , not the employer. The employer has been automatically entering SL claims to members approved for Weekly Indemnity benefits during the 3 day waiting period, or as a top up while on Weekly Indemnity benefits. A
recent arbitration case has confirmed this right and the union requests they be made aware of any instances where the arbitrators award is violated.
Remember it will be the members choice to either use their entitlement to Paid Medical Leave or hold it for future use, the employer does not have the right to make that determination.
